Terms and conditions - FoxyFy Server Software

1. Service Description

The Software consists of server-side applications designed to provide various system, network, security, or communication functionalities. It may include, without limitation, server services, middleware, management tools, or security components.

The Software is installed by the user on their own server environment and may require system-level access such as SSH, root privileges, or configuration changes. A valid license key may be required for activation.

2. Eligibility

To use the Software, you must:

Be at least 18 years old;
Have the legal right and permission to modify or administer the server on which the Software is installed;
Agree to these Terms.

3. License and Pricing

The Software is offered under a paid license model. Pricing may be available on a monthly or yearly basis, as listed on the FoxyFy website at the time of purchase (VAT included where applicable).

By purchasing a license, you obtain the right to use the Software for the duration of the selected billing period (monthly or yearly). When the billing period ends, the license expires automatically.

Licenses do not renew automatically. You must manually purchase a new license if you wish to continue using the Software after expiration.

All payments are final. No refunds are provided after purchase unless required by applicable law.

4. User Responsibilities

You are solely responsible for:

Managing, securing, and maintaining your server environment;
Ensuring correct installation and configuration of the Software;
Backing up your data and systems;
Compliance with all applicable laws, including privacy, security, copyright, and content laws;
Ensuring that the Software is used only for lawful purposes.

5. No Warranty / Disclaimer

The Software is provided “as is” and “as available”. FoxyFy makes no warranties of any kind, including but not limited to:

Uptime or continuous availability;
Performance, speed, or compatibility;
Fitness for a particular purpose;
Security or immunity from attacks.

You install and use the Software at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, FoxyFy and its owner are not liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Software. This includes, but is not limited to, loss of data, revenue, or business.

Total liability is limited to the amount paid for the license during the preceding 12 months.

7. Termination

You may stop using the Software at any time; however, no refunds will be issued.

FoxyFy may suspend or terminate your license if you violate these Terms or use the Software unlawfully. Upon termination, license data may be invalidated or disabled.

8. Intellectual Property

All rights to the Software, including code, documentation, and associated materials, remain the property of FoxyFy and its owner. You retain all rights to your own server data and content.

9. Legal Compliance

You are responsible for ensuring that your use of the Software complies with all applicable laws and regulations relevant to your jurisdiction and server operations.

10. Changes to Terms

FoxyFy may update these Terms at any time. Updated Terms will be made available on the FoxyFy website. Continued use of the Software constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by German law. Any disputes shall be resolved in the courts of Düsseldorf, Germany.
