1. About the Service

FoxyFy CDN is a content delivery network that provides static content caching specifically for WordPress websites. The service only works in combination with the atec-FoxyFy WordPress plugin, and no other integration methods are supported.

2. Eligibility

To use FoxyFy CDN, you must:

• Be at least 18 years old.
• Operate a WordPress site where the Atec-FoxyFy plugin is installed and functional.
• Agree to these Terms.

3. Service Scope

FoxyFy CDN provides:

• Caching and delivery of static content (e.g., images, CSS, JS files).
• Distribution of cached content via a network of edge servers.

The Service does not include:

• Hosting or storing original files.
• Dynamic content processing.
• Uptime guarantees or performance SLAs.

4. Pricing and Payment

The Service is offered for a flat annual fee of €49.

Payment is processed securely through third-party payment providers (e.g., PayPal).

The subscription is valid for 12 months from the date of purchase. No refunds will be issued after purchase unless required by law.

5. Account and Access

You are responsible for configuring the Atec-FoxyFy plugin correctly. Access to the CDN is automatically linked through the plugin activation and license.

Misuse or unauthorized distribution of the plugin or license may result in termination.

6. Content Responsibility

You are solely responsible for the content cached and delivered via the CDN. You must not use the Service to deliver any:

• Illegal content
• Infringing content (e.g., copyrighted material without authorization)
• Malicious code (e.g., viruses, malware)

FoxyFy does not monitor content proactively, but reserves the right to suspend access if notified of unlawful use.

7. Intellectual Property

All technology, code, and branding associated with the CDN and plugin are the intellectual property of Chris Ahrweiler.

You retain full rights to your own content delivered via the CDN.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

No guarantees are made regarding:

• Availability or uptime
• Speed or performance
• Data integrity or delivery

You use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

FoxyFy CDN and its owner shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

• Loss of data
• Downtime
• Loss of revenue or customers

Total liability is limited to the amount paid for the Service in the past 12 months.

10. Termination

You may cancel your use of the Service at any time, but no refund will be provided.

FoxyFy may suspend or terminate access if:

• You violate these Terms
• Illegal or harmful content is detected
• Plugin misuse or license abuse occurs

Upon termination, cached content may be deleted without notice.

11. Legal Compliance & Takedowns

You agree to comply with all applicable laws, including GDPR and German internet law.

FoxyFy complies with legal takedown requests and will act upon receiving valid complaints.
